Welcome to Deskifier. By accessing or using our website, application, or services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

1. Description of Service

Deskifier provides software that enables users to convert, wrap, or package existing websites and web applications into desktop applications.

• Free Tier: Allows previewing and testing applications within the Deskifier environment only.
• Paid Tier: Required to generate downloadable builds for distribution.

We may modify or discontinue features at any time.

2. Eligibility

You must be at least 18 years old (or the legal age in your jurisdiction) to use the Service.

3. Subscriptions, Payments, and Cancellation

• Billing: Paid plans are billed on a recurring monthly basis via Stripe. By subscribing, you authorize recurring charges.
• Cancellation: You may cancel at any time. Access continues until the end of the billing period.
• Refunds: No prorated refunds unless required by law.

4. User Responsibilities and Representations

By using Deskifier, you represent and warrant that:

• You own or have permission to use the website/content you submit
• Your content does not violate any laws or third-party rights
• Your use complies with all applicable laws and regulations

You are solely responsible for the content and behavior of any applications you create.

5. License Grant

You grant Deskifier a limited, non-exclusive, worldwide license to access, process, and package your submitted content solely for the purpose of providing the Service.

6. Acceptable Use

You agree not to:

• Distribute malware, viruses, or harmful code
• Package illegal, abusive, or deceptive content
• Reverse engineer or attempt to exploit Deskifier
• Circumvent usage limits or security measures

We may suspend or terminate accounts that violate these Terms.

7. Intellectual Property

• Your Content: You retain ownership of your website and content
• Deskifier Property: We retain all rights to our software, technology, branding, and platform

No rights are granted except as explicitly stated.

8. Third-Party Content Disclaimer

Deskifier does not control or endorse the websites or applications you wrap. We are not responsible for:

• Website behavior, availability, or changes
• Third-party content or services
• Compatibility issues within generated applications

9. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason including violation of these Terms. Upon termination:

• Your access to the Service will cease
• We may delete or disable your builds and data

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.” We make no warranties, including:

• That the Service will be uninterrupted or error-free
• That generated applications will function on all systems
• That defects will be corrected

11. Limitation of Liability

To the maximum extent permitted by law, Deskifier shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Issues arising from third-party content or websites

12. Indemnification

You agree to defend, indemnify, and hold harmless Deskifier and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your content or applications
• Your violation of these Terms

13. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
